Supreme Court: “No to Intrusion Into State Matters”
Today, the Supreme Court did exactly what it was supposed to do in regards to the Terri Schiavo case.
The issue is a legal issue, and the federal court system, ending in the U.S. Supreme Court, recognized that the only issue it had jurisdiction over was whether the State of Florida followed the legal remedies set out by its own State law.
That was all the Court had to look at in the 2000 case of Bush v. Gore. Did the State of Florida follow the guidelines, policies and procedures it had set forth Constitutionally to deal with an issue that was a State issue. In Bush v. Gore, the Court examined if the process outlined by the Florida Constitution had been adhered to in the process of counting the votes. Since it had, the Florida count total was found to be authentic by the State and Bush became President. Opponents make it out that the Supreme Court was picking the President when that was not the case. The issue before them wasn’t Presidential. It was the legal process for validating the vote in Florida as outline by Florida state law.
Likewise, the Schiavo case wasn’t a right-to-die case. It was a legal process case. The only issue the federal courts could look at was if Florida had exercised all the policies and protections outlined by their own state law to protect the rights of Schiavo. It was not an issue of whether Florida could murder a citizen. Or if her family really wanted her to stick around. It wasn’t a wrongful death type suit. It was plainly an issue of legal process.
And the Court made the right decision. They chose not to get involved in an issue where jurisdiction was clearly with Florida. Like it or leave it, that’s the legally correct answer.
