Hi Aaron. I was impressed with the effectiveness of the SOPA and PIPA boycott, but I have to admit that I was a little conflicted. I live in Nashville and about 1 in every 3 people I know are in the music business. They were loudly championing these bills, in desperate hopes of stopping illegal downloads and copying of their music. I believe that we already have good laws in place to help the musicians and they just need to be enforced and publicized. But it was hard to be against SOPA and PIPA without catching a lot of heat from the music business people.

I believe it not is completely dead, either. I was told it went back to committee for reconsideration. I have not heard a peep about it since and wonder if they are really going to make some changes and then try to push it through again? I hope not.

I was really glad to see that grassroots organizations are being more successful in recent history - partly the efforts to stop SOPA, and more recently the efforts to support Planned Parenthood. I think that these successes are bringing more hope to the younger generation that they really CAN make a difference.

An Open Letter to Congressman Lemar Smith, Architect of SOPA

I am a lifelong registered Republican. I am conservative, retired and hold a Ph.D. in Philosophy. Please understand that my sentiments below on your authorship of the SOPA legislation is meant to show no disrespect for the Office you hold. I do not question your intentions or goal; what I do question is the shallow and obvious non-existent thought that went into the crafting of this legislation. If our Founding Fathers had put as little thought into drafting our Constitution, I doubt the Republic would have survived 50 years.

Because the Law, including the U.S. Constitution and Declaration of Independence have their roots in Western philosophy, I have long had as much passion for the law as I do for philosophy. I have spent many decades embedded in the U.S. Constitution. I would suggest that you at least read or re-read the Constitution and The Federalist Papers before again embarking on such an ill-conceived piece of legislation without considering its Constitutional and global ramifications. The 13 Original Sovereign States, in their wisdom, granted only 17 enumerated powers to what was supposed to be a small, general or federal government. Yet, over the decades, a power-hungry Federal Government, with the grasping collusion of SCOTUS and its linguistically and historically unsupportable interpretations of many of the intentions of our Framers, has become “the tail wagging the dog.” Without diminishing the importance of intellectual property rights, our Republic right now is on life support and fighting for its very existence. Unfortunately, never in our history, has there been a more pressing time for Americans to retake many of the pilfered gifts our Founders gave us in the Constitution. If necessary, the States might need to reassert the concept of “Jeffersonian Nullification” when dealing with overreaching Federal legislation. Yet you spend your time crafting Constitutionally questionable confections for your political contributors.

I would suggest that you consider rewriting your own words on the public’s reaction to the provisions of SOPA, i.e., that you plan to “revisit the approach on how best to address the problem of foreign thieves that steal and sell American inventions and products.”

A more critically pressing and timely alternative to your words might be that you plan to “revisit how best to address the problem of domestic thieves, i.e., members of the U.S. Congress and of SCOTUS, who steal and sell the People’s rights, stealing from them the liberties guaranteed by the U.S. Constitution and indeed, stealing from the People for whom you all work, the very Republic Itself.” Add to the above concerns, the dictatorial provisions for suspending habeas corpus in the recently passed National Defense Authorization Act (NDAA), the power to strip citizenship contained in the upcoming Enemy Expatriation Act (HR 3166), the economy-killing provisions of ObamaCare (that no one bothered to read), and maybe that would help you to prioritize your efforts, and to understand the great angst that has paralyzed the Country. Barak Obama once said, “elections have consequences.” I would submit that sponsoring unconstitutional, un-vetted legislation also has consequences.

Respectfully,

Alan J. Pratt, Ph.D.

It's unconstitutional because of the 4th Amendment "Due Process" clause not because we have some right to the Internet. I love your passion but please don't be an idiot.

If you get this billed passed into law, you will be the one responsible for the aftermath.
Your corruption... Your audacity to even write a bill like this is astounding.
This bill WILL take away our first amendment rights. Our founding fathers set those in place to protect American freedoms.
It's our freedom to do what we please on the internet. The internet is a FREE place. What you propose is a restricted internet. Much like North Korea. Do you really want to be known as the man that turned a functioning democracy into a fascist empire? That sure does seem like a terrible thing to have on your shoulders, doesn't it? Your bill is unconstitutional. People like you should not be in power.
If it passes, I wish you good luck. You will need it.
If what you think you're doing is a good thing, stop for just a second and end the bill while you still have a shred of dignity left.
I hate to say it, but all the riots and whatnot that this bill will cause won't be out a forgiving group.
Again, good luck you corrupt bastard.

Like many Texans, I am strongly opposed to the proposed legislation included in SOPA & PIPA. These acts are a detestable and transparent grab for power by copyright holders that will do little to curb piracy, and will harm the American people. Numerous leading experts have come forward to express concerns that SOPA & PIPA could in fact damage the very fabric of the internet. The internet is a driving force for innovation and growth that should be the source of a continuing revolution in business and social interaction. SOPA & PIPA would compromise the internet, and would compromise our future. I hope you will consider changing your stance on SOPA & put this bill where it belongs - in the trash.

Dear Lamar Smith:

As a fellow Texan, you are a disgrace. As an American, you are a traitor.

Kissing the foot of the entertainment industry by taking the kickbacks their
lobbyists are giving you shows your true colors. You, Lamar Smith, are a
a textbook example of a sellout.

You would make people of all ages feel just like Jammie Thomas-Rasset,
the single mother who was sued by RIAA. By pushing a law that violates their
rights for not even HAVING any pirated material, and is as blatantly wrong
as the RIAA lawsuits themselves, you have made yourself look like a greedy
and inept fool. If we, the people, have the right to vote for you, we, the people,
have the right to oust you.

You hoped to stir up people to impeach Obama, but now YOU are the one
to FACE IMPEACHMENT. And the people will do so.

Well social media was always going to invite this sort of thing but what has to be considered is the ramification of it all. If there were at least three to every two dozen bloggers and social media users who could guarantee something that would detract away from what has been explained then I don't think we'd be in a situation where we have to get like that. Still, looking at it from an impartial perspective I think you also must consider why people use social media in the first place and, when that is opposed to the initial statement, the obvious conclusion is made. But, taking into account these elements, you then have the additional purpose of seeing where the whole process will be in a years time. Ultimately I would argue that it is an openended dilemma of somewhat irrelevant but necessary importance.

As a technology reporter who has covered Austin and San Antonio, I would say that all the leaders in both cities need to think more regionally. The combination of Austin-San Antonio is truly a powerhouse of technology and biotechnology activity. As for the Gowalla vs. Foursquare story, I think a lot of people root for the home team. And Gowalla had a great product in the beginning. With global technology companies like Dell, IBM and Rackspace, I don't think you could really say Austin doesn't embrace the global marketplace. And thousands of engineers from Taiwan, China and Singapore have received degrees at the University of Texas and Texas A&M and go back to run industry in their countries. Every region must compete for scarce resources - primarily engineering talent - so that's why so many cities tout every themselves as the best tech center. Now everyone's scrambling to become the "Clean Tech" capital of the world and Austin has already claimed that status. Clusters in green or clean tech attract even more companies, researchers, entrepreneurs, venture capitalists. (Citing Richard Florida's enormous body of work here) So there's a reason behind the slogans. It's not just marketing hype.

Now everyone’s scrambling to become the “Clean Tech” capital of the world and Austin has already claimed that status. Clusters in green or clean tech attract even more companies, researchers, entrepreneurs, venture capitalists. (Citing Richard Florida’s enormous body of work here) So there’s a reason behind the slogans. It’s not just marketing hype.

I don't think you can go broad strokes here Only rarely have I been asked to like or follow by colleagues Maybe because they know better but irs more about the meaningless numbers that are easy to measure & sound good to spreadsheet junkies The clustering isn't a bad thing Niche was my word of 2011 for a reason You want to reach more of the right people & satisfy their needs, wants, interests but you need good engagement & content approaches I only have 3 metrics: Thank you, wow & done Also, some of those who write books are helping people understand the difference between numbers & engagement (For the record I like the parties & events but could do without the egos)

Dude, you just haven't been here long enough to get all that damn Yankee blood out of you. :-)

I've spent plenty of time in Silicon Valley. Highly over-rated. SF and NYC too.

That said, seriously, one of the things I've observed among Austin startups is that for most of them, marketing is an afterthought, whereas that's not the case in other startup hotbeds. And as a result, I think (my impression) that we have in Austin a much higher percentage of products that make it to market (and maybe shouldn't) and then flop.

Marketing has to be a factor from the beginning -- integral to the product design. It's great to start a company based on a developer's itch, but if you want to actually make money and build a sustainable company, include marketing at a senior level from the very beginning.

Sounds a lot like the Bazaarvoice Labs concept:

Seems to work really well for them, I'm sure there's someone out there looking to emulate that approach.

If that were the case, then I would have seen Gowalla being used more often in other cities as well. It wasn't. Outside of Austin, Foursquare ruled. In Austin, people never shut up about Gowalla.

I think if you polled the majority of Gowalla users, they preferred it because it *was* a better experience. I'm using past-tense here because that changed as they evolved. That's as someone who was using and touting Gowalla prior to being in Austin. I was using BrightKite prior to that -- I don't have a regional horse in that game.

That aside out of the way, I'm with Keith, but from a different perspective. I'm so involved in some many sub-communities within Austin because there's so much going on. Same would go if I was in Portland, SF, SV, or any other place.

As for Austinites treating it like a bubble that exists completely unto itself -- I guess we're talking to different people.

As much as I prefer and promote Austin, I'm ecstatic that we've started interacting and working with Dallas and Houston more and more. Each group brings a different perspective, background, industry, technology, and general culture to the table. And the same applies to technology.. the Rails community does it one way, PHP another, C# another and everyone wants to be "right".

None of them - technologies, regions, etc - are "right" but all of them have strengths to take advantage of and build upon and weaknesses to mitigate and work around.

Just have to say thank you for this. Like many companies, we utilize social media. However, it's only a portion of all of the marketing we do. I believe the understanding of cold calling has been tossed out the window. Well...people want to speak with a human and they want content that's simple and reliable. Facebook is for quick updates and more about the news of the organization than anything.

I with you!

To be fair... We all kind of went through that same phase when we were starting out. Thought we were experts due to X, told people we were experts, started eventually doing "real work" and learned as we went.

Granted, we weren't pitching companies really, so there was less harm, and we were all having so much fun that the "social" in social media was more important than the "media"...

But still, I feel folk let us get our feet wet, learn and screw up. So while it sometimes annoys me tremendously, I ask myself what I'd do in their shoes and have a hard time coming up with a list of things that isn't pedantic (ie: don't hand out business cards everywhere, have a beer with someone instead of pitching them, etc).

Maybe I'm just old and weird though ;-)

Amen. Social media guru's and mavens typically know a little about facebook and nothing about marketing. I had a friend compare it to a cruise boat of 1000 musicians all trying to sell their cd to each other... and the scenario you describe - the circle tweeting to get your name out, and do favors for your other social media 'guru' friends is happening in my home town where everyone thinks they're a marketing expert and nobody actually is. I'll be sharing this blog on a few social site (yes i see the irony in that statement ;) )
